Terms & Conditions



Please ensure you read and fully understand these booking terms and conditions. If anything is unclear to you, please contact the owners so that it may be discussed and explained in further detail to avoid any possible misunderstandings. They are intended to be open, honest and fair, in the interests of all parties and stakeholders, in order to facilitate a comfortable and enjoyable Home from Home holiday experience for you and other visitors to Kiln House, whilst acknowledging the interests of the wider community and being protective of it also being the owners’ home.

  1. Bookings are subject to the following Terms & Conditions:

    1. A contract between you and the owners will come into existence when the deposit or full payment is received and a booking confirmation is issued showing that the holiday-let dates are confirmed.
    2. The contract binds you (the person making the booking) and all the visitors who are to be staying at Kiln House. It is therefore your responsibility to ensure that all members of your party are aware of and accept the terms of the contract set out in these Terms & Conditions. Failure to disclose any relevant information to the owners or comply with these terms may lead to termination of the contract and loss of the booking, plus additional charges.
      1. In the case of a family unit, or couple, your contact details and the number of adults and children that make up the party are required.
      2. If booking as a mixed group, of friends or work colleagues for example, the names and addresses of all the principle visitors are required. That is who will be regularly staying at Kiln House for the duration of the letting arrangement. Any proposed changes to this must be notified and agreed to.
      3. The number of adults and children staying must be stated correctly at the time of booking. Any changes or corrections must be notified before arrival.
      4. For their safety Kiln House and its garden are not considered suitable for children under 8 years old and it is recommended that young persons are suitably supervised at all times when present. Any such children brought to the property are entirely the responsibility of their parents, guardians or carers and no liability shall arise on the part of the owners in respect of them under this agreement.
      5. Because of its limited storage Kiln House is not equipped for infants and is therefore not considered particularly suitable for them. That does not exclude them being included among the visiting party, except that any infants brought to the property are entirely the responsibility of their parents, guardians or carers, as is the provision of any necessities needed for looking after them; and no liability shall arise on the part of the owners in respect of them under this agreement.
      6. You are responsible for the supervision of all members of your party under the age of 18 at all times.
  2. Payments & Cancellations:

    1. Payment:
      1. A 20% deposit of the holiday cost is payable at the time of booking.
      2. The deposit payment must be paid within 7 days of the booking being made.
      3. The full payment must be paid at or before 8 weeks (56 days) ahead of the arrival date.
      4. If the balance is not received by the due date, then your holiday will be treated as a cancellation.
      5. Bookings made less than 60 days before your arrival date must be paid for in full at the time of booking.
    2. Cancellation:
      1. All cancellations must be notified in writing and once received by the owners they will confirm the cancellation.
      2. Although reasonable steps will be taken to find a replacement booking, until one is found, or if not, the customer remains liable for a percentage of the booking cost when a cancellation is received, as detailed below:

        Two weeks to 8 days 90% of the total booking cost
        Three weeks to 15 days 70% of the total booking cost
        Four weeks to 22 days 50% of the total booking cost
        Five weeks to 29 days 40% of the total booking cost
        Six weeks to 36 days 30% of the total booking cost
        More than six weeks Deposit only
      3. If the owners are successful in getting a replacement booking, they will refund the total amount paid less a 5% booking fee and any difference in price between your original booking and the replacement booking, such as a Late Availability discount or special offer price.
      4. It is strongly advised that you take out comprehensive travel insurance to cover cancellations. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.
      5. If your booking is cancelled due to circumstances beyond the owners’ control, notification will be given of the cancellation as soon as possible and they will promptly refund all payments made to them for your holiday. The owners liability for cancellation will be limited to payments made to them.
      6. If Kiln House must close due to government restrictions or you are prevented from travelling for your holiday dates due to similar constraints, you will be refunded in full. This applies within the UK only. Any other scenarios will be considered on the specific circumstances.
  3. General Terms:

    1. The maximum number of persons occupying the property must not exceed 4 persons and only those listed at the time of booking may occupy the property. No extra overnight visitors are allowed to stay at the property. If you wish to invite additional visitors to visit you during your stay, please ask the owners first.
    2. You must not use the property except for the purpose of a holiday-let, or a letting that is otherwise within the scope of Kiln House’s Short-term Let Licence, if such has been agreed. No rights, permissions or privileges beyond the reasonable interpretation of this context are, or shall be, in any way implied. See also paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988.
    3. Bookings cannot be accepted from persons under 18 years of age.
    4. The owners reserve the right to refuse a booking without giving any reason.
    5. The owners or their representatives reserve the right to enter the property at any time to undertake essential maintenance, repairs, or for inspection purposes.
  4. Further Considerations:

    1. Kiln House is set up as the owners’ home, in addition to being a well-equipped holiday-let. Its visitors are encouraged to feel at home themselves when staying there. However, are also asked to use the property, its contents and surroundings with reasonable care and respect, so that others may continue to enjoy it afterwards.
      1. This means you are expected to take reasonable care of Kiln House and its furnishings and fittings throughout your stay and to be responsible for regular household considerations such as topping up the dishwasher salt and rinse aid when the dishwasher indicates this is necessary etc. The onus is on its visitors to maintain good standards overall and to deal with any minor domestic practicalities as they would do in their own home.
      2. Please respect the interior of Kiln House and remove outdoor shoes and clothing before entering the main living spaces. Please contain the effects of being outside in the Highlands of Scotland to the entrance vestibule and kitchen-dining areas as much as possible, which have tiled floors.
      3. Occasionally things happen: Any accidental breakages or mishaps should be notified to the owners so that the item may be replaced or the matter rectified.
      4. Visitors are also asked to notify the owners and liaise with them about spares or replacements as necessary, to ensure that minor maintenance issues might be taken care of and the experience of being at Kiln House remains a quality one. Checks are made periodically, although obviously it helps to be informed of anything that could go unnoticed at a changeover.
      5. If there is a problem or you have a complaint please let the owners or their representatives know immediately, so they have the opportunity to resolve it.
    2. Scotland has a strict approach to recycling and may issue notices or impose fines for the incorrect use of the bins. Please follow the guidance on this given in the Visitor Information.
      1. Where bins are not emptied because they contain the wrong items the onus is on visitors to sort their waste again properly, so that it will be collected next time.
      2. If a fine is issued for misuse of the bins the owners may charge this to the visitors involved.
    3. Strictly no smoking or vaping is allowed anywhere on the property, either inside or outside, including pathways and parking areas.
    4. No parties. Gatherings involving substantial numbers, or group celebrations such as Hen or Stag parties that have the potential to become unruly, are not allowed at Kiln House. However, this does not prevent its visitors from entertaining family and friends, as if at home, or marking personal occasions such as Birthdays or Anniversaries.
    5. No pets. In exceptional circumstances well behaved animals may be permitted, however, this must be by prior arrangement with the owners and may involve additional fees, plus deep cleaning costs.
    6. Please park your vehicle in the designated parking space for Kiln House, ensuring it does not impede access to any of the other properties. Parking is limited to a maximum of 2 vehicles, the second of which must be parked in the overflow parking area belonging to the Keltneyburn Milton. Note that other properties have a right to use this space too, so please park with this in mind.
    7. If a larger vehicle is being used during the stay, such as a pickup truck or van, it must be kept in the overflow parking area belonging to the Keltneyburn Milton and parked considerately, so as not to obstruct its other users.
    8. The Keltneyburn Milton is a small community with some permanent residents. Please be good neighbours to those living nearby and in the local area.
    9. Visitors agree to reasonable use of the Utilities and Services.
      1. All included services are subject to the reasonable use of them. Kiln House has a smart meter for its electricity and its water supply is metered also. Expected usage is generously factored into the pricing on the basis of known costings for comfortable domestic conditions. In the event that this is exceeded through unreasonable use of the utilities additional charges may apply.
      2. You agree to reasonable and lawful usage of the Fibre to Property Broadband at Kiln House.
    10. Please lock the doors and close the windows when you are not at the property.
    11. Please clean the barbecue after use.
    12. Not complying with any of the above may result in the agreement being terminated.
  5. Implied & Included Terms:
    1. Visitor Information is provided before your arrival and is kept at Kiln House for reference during your stay. Although for the most part this is intended as Useful Information to help you make the most of your holiday, some of it may concern the reasonable expectations and responsibilities of the parties and from time to time visitor communications* will include details, or convey relevant or updated facts, that shall be interpreted as being part of this agreement, regardless of whether or not they are specifically included in it. For example the following instances of advice and guidance, which deal with practicalities and may appear elsewhere in correspondence or documentation, are by implication included:
      1. Bed linen, towels and a few complimentary toiletries are provided, as is a modest welcome pack of coffee and tea etc. for your arrival. Some kitchen essentials are included too. However, Kiln House is self-catering and further provisions during the stay are the visitors’ responsibility.
      2. Please help Housekeeping to do their work by sticking to agreed arrival and leaving times. Lettings commence at 16.00 (4 p.m.) on the arrival date and visitors are required to leave Kiln House by 10.00 (10 a.m.) on the day of departure. Occasionally it may be possible to make alternative arrangements, however, that must be agreed to by the owners in advance.
      3. Like many country properties Kiln House is connected to a septic tank, not to mains drainage. This type of biological waste treatment system only functions well with easily degradable substances and is sensitive to misuse. So please do not put feminine hygiene products, nappies, paper towels, wipes, cotton wool pads, or contraceptives down the toilets. Please also avoid putting anything into the bathroom and kitchen drains other than waste water.
      4. The Kiln House garden is a mixture of managed and natural spaces that is lightly maintained by its gardeners throughout the year. However, since it is virtually impossible to keep on top of seasonal conditions such as falling leaves, which collect again almost as soon as they are cleared, or snow, which is to be expected in winter in Highland Perthshire, or ice formed by freezing rain, the onus is on visitors to take care of the outside areas, such as pathways and steps in the garden, to ensure their own safety during their stay at Kiln House and that of others; and to take such action as is prudent, for example if necessary to use the yard brush hung on the outside of the shed to keep the external walkways clear and safe, or to apply rock salt in appropriate conditions, etc.
  6. Liabilities & Charges:

    1. The owners reserve the right to terminate your rental agreement with immediate effect where the unreasonable behaviour of yourself, or members of your party, that is the persons named on the booking or their guests, or anyone you have allowed to be present, may impair the enjoyment, comfort or health of others. You will be asked to leave the property, without any refund of the rental amount paid.
    2. If damage occurs due to deliberate, negligent or unreasonable behaviour of any visitors during your stay the owners may bring a claim against you for any loss arising as a result, which may include compensation should it be necessary to cancel or refund subsequent bookings.
    3. The owners reserve the right to make a charge to cover additional cleaning costs if the visitors leave the property in an unacceptable condition.
    4. The owners reserve the right to pass on charges arising from the misuse of the bins (see IV. 2. ii above) or the septic tank (see V. 1. iii above) where reasonable and appropriate.
    5. Please note that if any keys made available to you are not returned at the end of your stay, then the cost of replacements will be charged to you.
    6. The owners shall not be liable to you or your holiday party for loss or damage to property, however arising.
  7. Dispute Resolution:

    1. This contract is made in the United Kingdom and shall be subject to its laws.
    2. Any dispute arising out of or in connection with this contract shall, if not settled amicably between the parties, be referred to a Mediator for resolution and only if that is unsuccessful shall Proceedings be issued.



*Visitor Communications may include emails, documents, or notices by which information is conveyed during the process of making a booking, or once it has been made, or during your stay at Kiln House.
